Circuit Court Decision Helps Reveal ObamaCare Ruse

Today the DC Circuit Court of Appeals struck a major blow to the Affordable Care Act (ObamaCare) by ruling against the Obama administration in the case Halbig v. Burwell.

The crux of ObamaCare is that the government offers exceptionally lucrative subsidies to individuals that purchase heavily regulated insurance coverage on government-facilitated exchanges.  

Today’s decision, however, found that these subsidies have been promised illegally by the Obama administration to millions of people in the 36 states that have objected to ObamaCare and have forgone establishing exchanges. The ruling of the court stated that the law, quite plainly, only authorizes subsidies to be issued in states that have established exchanges.

“What makes this decision so impactful is that it strikes at the heart of the ObamaCare ruse. These subsidies are the so-called ‘affordable’ part of the Affordable Care Act, hiding the direct cost of insurance from the individual purchasing the plan and dispersing it through a massive tax increase on businesses and new debt for our children to shoulder. Sweeping the problem of skyrocketing healthcare costs under the rug isn’t solving it. The elimination of these illegal federal handouts should help reveal to millions of Americans that more authentic, market-based health reform is needed in place of the ObamaCare bait-and-switch.
 

This is also a decisive victory for the rule of law over the whims of the powerful. The Obama administration illegally issued these subsidies in order to prop-up a deeply unpopular program in the face of protest from the state governments. The administration promised money Congress never authorized them to spend in a clear violation of Congress’s constitutionally guaranteed power of the purse. The DC Circuit Court’s decision is just the latest example of why the Founding Fathers made separation of powers an integral part of the Constitution and why we should seldom question their wisdom and foresight.”
